ATLANTA – Delta Community CU last week won dismissal of an ATM disclosure suit brought by a New York man who has filed at least six suits under the Electronic Funds Transfer Act.

The dismissal came after Delta Community showed photographs of the ATM fee disclosure that had been taken and provided by its ATM servicer, Automated Teller Accessories Corp.

The suit had been filed in the U.S. District Court in New York by Yehuda Katz, who claimed the credit union’s ATM at a LaGuardia Airport terminal in New York lacked the required on-machine disclosure of fees it charges non-members.

Katz also has filed EFTA suits against Mid-Hudson Valley FCU, Capital One Bank, Select-A-Branch ATM Network and others in recent months.

Lawyers for the credit union did not return phone calls seeking comment.
