WASHINGTON – The Senate last night approved the bill to eliminate one of the dual fee disclosure requirements at ATMs, a measure aimed at eliminating so-called ATM vigilantes who file civil suits over the absence of on-machine disclosures.

The Senate passed the version of the bill approved last summer by the House, meaning the measure is on its way to the President for his signature.

The bill means that a single disclosure of fees, like those typically provided on ATM screens, are adequate to satisfy the requirement of the Electronic Funds Disclosure Act.

The bill will not solve the more than 50 suits brought by ATM vigilantes over the absence of the on-site disclosure, but will prevent future suits.
